Does the husband have a right on the property gifted by his brothers?

If all the brothers gift property to their sister, then its ownership right is completely with the sister. According to the law, after the gift deed, the property is considered to belong to the one in whose name the gift has been made. In such a case, the husband has no direct right over it. If later the sister wants to sell or transfer that property.

Even then she does not need the consent of her husband in the legal documents. But if the sister dies and has not made a will, then in that case the husband can claim his share as the legal heir of that property.

What is a gift deed?

Gift deed is a legal paper through which a person gives his property, land or house to someone else without taking any money. In this, the giver is called donor and the receiver is called donee. But this document is considered legal only then.

When it is made on stamp paper and registered in the registry office. After doing so, the full right over the property goes to the person in whose name it has been gifted. Overall, the gift deed is proof that now the real owner of the property is the one to whom it has been given.
