Husband Alimony Rights: Does the husband also get alimony money after divorce? Know your legal rights

Alimony Rights For Husband: In divorce cases, there is often a perception that only the wife gets the alimony amount . But Indian law does not discriminate on the basis of gender in this matter.

If the husband is financially weak and the wife’s income is more than him, then he can also be entitled to get alimony. This right is completely protected by law.

What does the law say?

In India, under Section 24 and 25 of the Hindu Marriage Act, 1955, either of the spouses can demand alimony from the court during a divorce or marital dispute. This provision is gender-neutral, that is, not only women, but men can also avail it. The court takes into account the financial condition, lifestyle and duration of marriage of both the parties while considering this demand.

Recently, a famous case came to light in which Alok Maurya, who is a minor employee in the Panchayati Raj Department of Uttar Pradesh, demanded alimony from his wife Jyoti Maurya, who is a PCS officer. He filed a petition in the Allahabad High Court saying that his wife’s income is many times more than his and she is suffering from many diseases, so he should get alimony. The family court had rejected his petition, but the High Court took the case seriously and issued a notice to the wife and fixed the date of hearing.

Do husbands also have alumni rights?

This makes it clear that the right to alimony is not limited to women only. If the husband can prove that he is financially weak and the wife is capable, then the court can give him relief. The purpose of the law is to ensure that after divorce, neither party, be it the husband or the wife, remains financially helpless. Therefore, the courts look at each case on a different basis and give their decision.

So if a man feels that he has become financially helpless after divorce and his wife is capable, he can seek help from the law. This right is protected by both the Constitution and the Marriage Act.
