Allahabad High Court has given an important decision related to the employees. The High Court has said that no employee can be kept suspended for more than 3 months. Along with this order, the High Court stayed the suspension of the police inspector.

Significantly, Police Inspector Keshav Verma, posted at Handia police station in Prayagraj, was suspended on April 11 this year. Even after lapse of 3 months, no departmental charge sheet was given to him. Staying the suspension of the Inspector till further orders, the court has sought a reply from Prayagraj SSP in 4 weeks.

This order has been passed by Justice Neeraj Tiwari on the petition of Police Inspector Keshav Verma. The petitioner Inspector was suspended under the provisions of Rule 17 (1) (a) of the Uttar Pradesh Subordinate Grade Police Officers (Punishment and Appeal Rules) 1991. After this he was attached to Prayagraj Police Line Prayagraj.

Senior advocates Vijay Gautam and Atipriya Gautam argued on behalf of the petitioner inspector that the suspension order is against the rules and regulations. More than 3 months have passed since the suspension order was passed, but the department has not yet given the charge sheet of any departmental inquiry to the petitioner. It was said that thus this suspension order is against the law and order given by the Supreme Court in the case of Ajay Kumar Chaudhary and deserves to be quashed.

This is the case-

According to the case, when the petitioner was posted as Police Inspector in-charge of Kalyanpur police station, district Fatehpur, he had arrested the accused named in the FIR. But, he did not make meaningful efforts to recover the kidnapped girl. When the girl could not be recovered, the High Court had shown strictness and personally summoned the Prayagraj Inspector General of Police to the court on the habeas corpus petition. Because of this, the petitioner was suspended during his posting in Prayagraj.
