Delhi Government: Orders have been issued for timely payment of bonus and dearness allowance on Diwali to the contract workers working in the departments of Delhi Government. In this regard, in the order issued by the Labor Commissioner’s office, strict orders have been given to the contract workers working in all the departments to pay bonus and dearness allowance on behalf of the contractors before Diwali.



New Delhi. Before Diwali, the Central Government has issued an order to increase the dearness allowance of its employees by 3 percent. At the same time, now the state government is also issuing orders for its employees to pay Diwali bonus and dearness allowance on time. In this regard, an order has also been issued by the Labor Commissioner Office of Delhi Government. In this, strict orders have been given to the contract workers working in all the departments to pay bonus and dearness allowance on behalf of the contractors before Diwali.

In the order issued by the Additional Secretary (Labour) SC Yadav after the approval of the Labor Commissioner of Delhi, it has been clearly and categorically expressed that there are large number of outsourced workers in various departments of the Delhi Government. (Outsource Workers) is working. There are complaints from these outsourced workers that they are not getting bonus from the contractors. Taking such complaints seriously, an advisory has been issued by the Labor Commissioner’s office.

In this advisory issued by the Additional Secretary, the Central Bonus Payment Act, 1965 and the Contract Labor (Regulation and Abolition) Act, 1970 have also been mentioned. as well as

Referring to not all sections, it has been advised that before Diwali, bonus and dearness allowance etc. should be paid to the contract workers.

Along with this, it has also been clarified that if an employer does not do so, then under different sections of the Industrial Disputes Act, 1947, there is a provision for punishment for the establishment / contractors and recovery of bonus amount from it. There are such provisions in Section 28 and 33(C)(1) of the Act.

Responsibility of key employers to ensure compliance with labor laws

Citing the Contract Labor (Regulation and Abolition) Act, 1970, it has also been said that it is the job of the principal employers to ensure that the contractors are properly following the labor laws in this direction. So all the major employers should ensure whether all the contractors have paid the bonus of upcoming Diwali to the contract workers or not. Non-payment of bonus has been reported as a serious matter.

Order sent to all principal secretaries and secretaries

A copy of this advisory issued by the Additional Secretary was also sent to the Principal Secretaries, Secretaries, HODs and Autonomous Bodies of all the departments. Apart from this, its copy has also been sent to the Secretary of the Ministry of Labor, the Private Secretary to the Labor Commissioner and the DLC (Admin) of the Labor Department.

More than 60 thousand contract workers in Delhi government

Let us inform that in the form of contractor companies, more than 50 thousand contract workers of ICSIL, NIELIT, BECIL and other contractor companies are employed in various departments. Talking about the IT and technical manpower staff in the Education Department of Delhi, the NIELIT contractor company has about two to two and a half thousand contract workers as data entry operators.



Similarly, all the 11 revenue districts of Delhi government also have outsourced staff. There are at least 18-20 contract workers in every district. About 400-450 contract workers are working as Data Entry Operators (DEOs) in all the district election offices. Apart from this, more than 30 thousand guest teachers are also working as contract teachers. But all these have been recruited directly by the department. At the same time, a large number of outsourced workers are working in various departments including Sales Tax, Trade and Tax, Environment, DPCC, Food Safety, Food and Supply, GAD, Drugs Control, AYUSH.

Dearness allowance will be made 31 percent from July 1, 2021

Let us inform that regarding giving Diwali bonus and dearness allowance to central employees, the Ministry of Finance has said that Dearness Allowance for central employees has been increased from 28 percent of the basic salary to 31 percent. It has been done and it has become DA Implemented with effect from 1st July 2021.
