Police can’t take out the key or the wind

It is wrong to remove the car key or air by the traffic police. Allahabad High Court lawyer Kripesh Mishra told in a conversation with media that, according to the Motor Vehicles Act 1988, the traffic police cannot remove the key or air from the vehicle without the permission of the driver. If any such incident ever happens to you, then you can also complain to the senior police officer in the nearest police station.

According to the rules of the Indian Motor Vehicle Act 1932, only Assistant Sub Inspector, Sub Inspector, Inspector can impose a fine on you for breaking the traffic rule. During this time only the traffic constable can help. To fine the driver, it is mandatory for the traffic police to have a challan book or an e-challan machine. If you do not have a challan book or an e-challan machine, then you cannot be fined.

A traffic police head constable can impose a maximum fine of Rs.100 only. Only one ASI or SIs can impose a fine of more than Rs.100. If you do not have the fine amount for breaking the traffic rules, then it can be paid later also. For this, the court issues a challan. During this, the traffic police collects the driver’s driving license.

The traffic police should wear a uniform while on duty, which should bear his name. If the traffic police has kept clothes containing silicone, then there should be an identity card. To avoid such situations, the driver should carry the driving license, PUC certificate, along with other necessary documents during the journey. Apart from this, traffic rules should be followed.
