Pepsico lost the legal battle over the Mountain Dew title

New Delhi. PepsiCo has suffered a major setback over the Mountain Dew case. PepsiCo, which is fighting a legal battle over the Mountain Dew title, has lost to claims by MagFast Beverages. Experts say that after this defeat, Mountain Dew will no longer have a monopoly of PepsiCo. Megfast chairman said that he had won the case in December last year, but till now he was waiting for the legal papers. He said that he wanted compensation from PepsiCo, because in 2004, Pepsiks said in an affidavit that it was ready to pay all necessary compensation if it lost the case to Magfast.




Let me tell you that Megastast, another beverage maker, has given legal defeat to PepsiCo in the matter of using the trademark. Megfast Beverages Company has now been legally approved by the court to use the trademark ‘Mountain Dew’. Syed Ghaziuddin, chairman of Hyderabad-based Megfast Beverages, told the media that in 2000, he started selling packaged drinking water called ‘Mountain Dew’. After this, in 2003, PepsiCo launched a soft drink with the same name.

He said that PepsiCo itself had filed a case of illegal use of the name against him. In this legal battle, all the courts from Delhi High Court to Megafast Beverages had ruled in favor. He told that this fight lasted for about 15 years and in the end he has won. The court rejected the claim made by PepsiCo.
