In a major relief for the poll body, both the Rajya Sabha Chairman and the Lok Sabha Speaker have rejected the opposition’s motion to remove Chief Election Commissioner (CEC) Gyanesh Kumar. The decision was announced through two identical parliamentary bulletins on Monday night, April 6, 2026.
The motion, spearheaded by the INDIA bloc and steered by the Trinamool Congress (TMC), had been submitted on March 12, 2026. It was signed by 130 members of the Lok Sabha and 63 members of the Rajya Sabha.

The Grounds for Rejection
The presiding officers of both Houses exercised their powers under Section 3 of the Judges (Inquiry) Act, 1968.

Objective Assessment: Rajya Sabha Chairman CP Radhakrishnan and Lok Sabha Speaker Om Birla stated that the refusal followed a “careful and objective assessment of all relevant aspects.”

No Admission: Both bulletins noted that after “due consideration,” they had refused to admit the notice of motion.

Legislative Shield: The CEC can only be removed through a process similar to that of a Supreme Court Judge, requiring a special majority in both Houses after an inquiry. By refusing to admit the motion, the presiding officers have effectively blocked the inquiry phase.

The 10-page notice filed by the opposition leveled several serious charges against Gyanesh Kumar, focusing on the Special Intensive Revision (SIR) process:
