The Income Tax Department is sending alert messages to taxpayers who filed ITRs using false or forged receipts, giving them a chance to correct their returns. Can ITRs be corrected after December 31st?
Taxpayers often file fake ITRs under the influence of others, while others make mistakes while filing. In both cases, the taxpayer’s refund gets stuck. The question now is whether ITRs can be corrected?
Section 139(5) of the Income Tax Act provides an opportunity to file a revised or delayed income tax return (ITR). Taxpayers can correct any errors in their returns, however, until December 31st. After that, no amendments to the return are permitted. Therefore, all taxpayers should file their ITRs promptly.
What do experts say about ITR correction?
Regarding ITR correction, Sudhakar Sethuraman, partner at Deloitte India, said that filing revised or delayed returns after December 31st is not permitted.
Mihir Tanna (SK Patodia & Associates LLP) explained that technically, revisions are not possible after December 31st. However, taxpayers can file updated returns provided the amnesty application is accepted. However, before filing updated returns, taxpayers will have to pay additional tax and interest on undisclosed income.
