GST Amnesty Scheme: Big news for tax payers! You can appeal against the GST tax demand order till January 31

GST Amnesty Scheme: There is good news for the taxpayers struggling with the complications of GST. Today you can appeal against the GST tax demand order till January 31, 2024.


There is a good news for taxpayers struggling with GST issues. To help these taxpayers, the Central Board of Indirect Taxes and Customs (CBIC) has started the amnesty scheme. This scheme allows GST taxpayers to file appeals against GST tax demand orders till January 31, 2024.

GST taxpayers can appeal against the tax assessments issued till March 2023. Under the GST Act, a taxpayer can file an objection against the tax assessment within three months of its issue. Obviously the purpose of this scheme is to give another chance to those people who disagree with the GST tax demand order and have not been able to appeal against it.

Relief from fines under Amnesty Scheme

Individuals who are unable to file their returns on time have to pay a penalty in the form of late fee. Late fee for delay in filing GSTR 3B is Rs 50 per day. Tax liabilities include State Goods and Services Tax (SGST) and Central Goods and Services Tax (CGST) with a penalty of Rs 25 per day. In case there is no tax liability in SGST or CGST, the late fee is Rs 10 each, i.e. a total of Rs 20 per day. However, now there is a possibility of getting relief from these fines under the Amnesty Scheme.

Who can file GST Amnesty Scheme?

  • A person who does not appeal against the GST tax demand order issued through a GST officer on or before March 31, 2023.
  • Cases where the previous appeal against the GST demand order was rejected merely because the time limit for appeal had exceeded.
  • The amnesty scheme is also for GST demand orders issued on or before March 31, 2023, including orders relating to the financial year 2018-19.

How to file?

  • To avail the amnesty scheme, the individual will have to file an appeal against the GST tax demand order using GST form APL-01.
  • In the notification, CBIC said that the appeal against the said order in Form GST APL-01 should be submitted on or before January 31, 2024. Appeal can be filed under GST Amnesty Scheme only through this form.
