Unnao Justice Battle: Survivor to Move SC Against Sengar’s Bail

Mandi House Protest: Survivor and Mother Detained Amid Safety Fears

The thing is, the Unnao rape survivor just described a court order as “death” for her family.2 Basically, the Delhi High Court on Tuesday (December 23, 2025) suspended the life imprisonment of expelled BJP leader Kuldeep Singh Sengar. Actually, Sengar has been in jail for roughly seven years and five months.

As a result, the court felt that since he has already served the minimum seven-year sentence for “non-aggravated” penetrative sexual assault, he could be released on bail while his appeal is pending (let’s be real, this is a massive blow to the survivor’s fight for justice).

And here’s the kicker. The survivor is heading straight to the Supreme Court.5

Specifically, she and her mother staged a high-profile protest near Mandi House and India Gate today (Wednesday, December 24).6 Instead of a quiet legal battle, they are taking to the streets, claiming that their security—provided by the CRPF—is being undermined and that they live in “constant fear.”

In fact, Congress leader Rahul Gandhi met with the survivor today at 10 Janpath, calling the situation evidence of a “dead society” where rapists get bail while victims are treated like criminals.7 Consequently, the survivor vowed she would not stop until the Supreme Court cancels the bail order.

In fact, Sengar isn’t walking out of jail just yet. The thing is, he is also serving a 10-year sentence for the custodial death of the survivor’s father.9 Actually, while he got bail in the rape case, he has not been granted relief in the death case.

 As a result, he will remain behind bars for now.11 Instead of a tidy wrap-up, the High Court argued that it cannot keep a person in custody just because of “apprehensions” that the police might not do their job in protecting the victim.

The thing is, the survivor’s lawyer argued that the “public servant” status of Sengar should have kept the charge as “aggravated,” which carries a life term. Basically, the High Court disagreed, ruling that he didn’t fall under the specific definition of a public servant for the purposes of the POCSO Act in this instance.

And then Y followed. This legal technicality is exactly what the survivor plans to challenge in the Supreme Court. Consequently, the case that shocked India in 2017 is heading back to the highest court in the land, eight years later.
