Teacher Bharti Rule: Supreme Court has made TET Mandatory for Teachers to Remain in Service or for Promotion

New Delhi ( Teacher Recruitment) . The Supreme Court has recently given an important decision . Now it will be mandatory to pass the TET (Teacher Eligibility Test) to remain in the teaching service and get promotion.

The division bench of the court clarified thatThose who wish to become teachers It is mandatory for both the employed and the former to pass the TET . This decision is being considered a big step towards ensuring quality of education and providing qualified teachers to the children .

At present, this decision has not been taken for minority educational institutions. Teachers who are going to retire in less than 5 years are being allowed to remain in service without passing the TET. But if they want promotion, it will be mandatory to pass the TET. Teachers who have more than 5 years left in service will have to pass the TET within 2 years. If they do not pass the TET within the stipulated time, they will be compulsorily relieved from service. Then they will be eligible only for terminal benefits as per the rules.

Supreme Court’s supreme decision: New requirement of TET

The Supreme Court clarified that passing the TET is now a mandatory condition for becoming a teacher or getting promotion. This direction is based on Section 23 of the RTE (Right to Education) Act and the minimum qualification framework set by NCTE in 2011. The court said that this step has been taken in the direction of raising the level of education and ensuring the best interest of the children.

If you are close to retirement then know the rules

Teachers who have less than 5 years left for retirement have been allowed to continue in service even if they have not passed the TET till then. But they will not be entitled to promotion. If they want to get promotion, they will have to pass the TET. This decision has been taken keeping in mind the practical approach and justification. This will not discriminate against other candidates.

What if you have more than 5 years left until retirement?

Teachers appointed before the implementation of RTE (2009) (who have more than 5 years left in service) have been directed to pass the TET within two years. If they fail to do so, they will have to leave the service or retire compulsorily. Only after this will they be able to avail terminal benefits. They will also have to complete qualifying service.

What is the impact on minority institutions?

The Supreme Court has raised doubts over the 2014 Constitution Bench decision which said that the RTE Act does not apply to minority institutions. In this context, the court has ordered the matter to be sent to a larger bench. This will decide whether the existing rules can be applied to minority institutions or not. Till then, these institutions have been temporarily exempted from TET.
