The Maharashtra government has issued an important and decisive order regarding the redevelopment of cooperative housing societies.
Maharashtra Cooperative Commission Commissioner Deepak Taware has clarified that the Registrar and Sub-Registrar no longer have the authority to issue ‘No Objection Certificate’ (NOC) for the redevelopment of cooperative housing societies. According to PTI news, Commissioner Taware has clarified in his order that the general body of the concerned cooperative housing society is the supreme decision-making body in the redevelopment process.
Limited role to surveillance
Citing a writ petition filed in the Bombay High Court and a 2019 Government Resolution (GR), the Commissioner said the role and duties of the Registrar and Cooperative Societies are limited to “monitoring” only.
There is no provision in the Act
The senior official maintained that there is no provision in the Maharashtra Co-operative Societies Act, 1960 that empowers the Registrar to issue NOC for redevelopment of any co-operative housing society.
Direct effect of the order
The order clearly directs that registrars and sub-registrars should no longer request applications for NOCs for redevelopment from cooperative societies, nor should they issue such certificates. This decision provides cooperative housing societies with greater autonomy in the redevelopment process and could help speed up the process, as they no longer have to wait for unnecessary administrative approvals.

Preparations to implement the amended rules also
Maharashtra has approximately 1.25 lakh housing societies with over 20 million members. Nearly 70 percent of these societies are located in the Mumbai Metropolitan Region (MMR). The state government will soon implement revised rules for cooperative housing societies. A draft of these rules was released on April 15, 2025, and public comments were sought. This draft has been released after a wait of nearly five years.
