According to the rules of NHAI, it is mandatory to maintain a distance of at least 7.5 meters from the highway boundary. Any kind of construction within 5 meters from the highway boundary is completely prohibited. If any construction is to be done, then it is necessary to get NOC (No Objection Certificate) for it. Any construction done without permission will be considered illegal. Therefore, it is mandatory for all people to follow these rules.
NHAI’s minimum distance rule: According to the National Highway Authority of India (NHAI), a distance of 7.5 meters from the highway boundary is mandatory. This rule was updated in 2021, earlier this distance was 3 meters for houses.
Complete ban up to 5 meters: No construction can be done up to 5 meters from the boundary stones of the highway. This rule has been made for the safety of the road and traffic.
Conditional construction within 5-7.5 meters: For construction within this distance, it is necessary to obtain a No Objection Certificate (NOC) from NHAI. The owner has to give an affidavit that the building can be demolished for highway expansion.
Distance from centerline (rural): In rural areas, construction is prohibited 22-40 meters from the centerline of the highway. The exact distance depends on local regulations and the type of highway.
Distance from the centerline (urban): In urban areas, the distance from the centerline is 18-30 meters. This distance is decided keeping in mind the traffic and safety in cities.
Rules for expressways: A distance of 15 metres may be mandatory for construction near expressways. This distance can be up to 60 metres from the centreline.
Necessity of NOC: It is necessary to obtain NOC from NHAI for any construction near the National Highway. Without this, the construction can be considered illegal and can be demolished.
Following local rules: Distance rules may vary slightly in each state, so get information from the local PWD. Permission may also have to be taken from the Municipal Corporation or Panchayat.
Purpose of distance rule: These rules are for road safety, highway expansion, and protection from air and noise pollution. Legal action can be taken if these rules are not followed.
