Court calls BMC’s action to demolish part of Kangana Ranaut’s bungalow as malicious

On Friday, the Bombay High Court made significant remarks in favor of Kangana, over the actress Kangana Ranaut and the BMC (Brihanmumbai Municipal Corporation) dispute. The Bombay High Court on Friday said that the action taken by the Brihanmumbai Municipal Corporation (BMC) to demolish part of the bungalow of actress Kangana Ranaut was malicious and was done to harm the actress. The High Court said that there is evidence that the structure was already in place and BMC action was taken with the wrong intent. The court quashed the demolition order. This is seen as Kangana Ranaut’s victory.

The High Court also said that the court does not allow the administration to use muscle power against any citizen. Talked about appointing an assessor to assess the damage done to Kangana so that the compensation amount can be determined. A bench of Justices SJ Kathwala and Justice RI Chagla said that the action taken by the civic body was unauthorized and there is no doubt. The bench was hearing a petition challenging the order of action taken by BMC on September 9 by Ranaut in his Pali Hill bungalow in suburban Bandra.

The bench said that the civic body has taken wrong action against the rights of a citizen. Kangana had asked for two crore rupees in damages from BMC and requested the court to declare BMC’s action illegal. On the issue of compensation, the bench said that the court is appointing an Assessing Officer to assess the damages which would hear the petitioner and BMC on the economic loss caused by the demolition. The court said that the Assessing Officer would pass an appropriate order on compensation by March 2021.
